Wikipedia reports that the Electronic Frontier Foundation, an international non-profit advocacy and legal organization based in the United States, has asked the U.S. Copyright Office to exempt jailbreaking from those prohibited by the copyright law in order to allow iPhone owners to use their phones with applications that are not available from Apple's store. Apple is opposing this request and said that they consider jailbreaking a violation of their copyright. The decision of the copyright office though is not expected until sometime later this year. Therefore, any jailbreaking activity is at one’s risk, at least until this ambiguity is cleared.

Jailbreaking is a very rewarding activity that gives users access to thousands of applications not available to them through the App Store. The applications may be had either for free or for a fee. Being internet connected, it can access applications in different fields such as entertainment where internet games and tunes are available, educational and informative materials and even software. The extensive and almost unlimited number of applications accessible make jailbreaking popular to internet enthusiasts, game fanatics, students, travelers who view google maps for locations and directions, as well as to all generations and levels of society. It is a lure that is difficult to ignore. To others, access to the rich information lode thru jailbreaking makes them feel tech savvy and excited. Right now though, jailbreaking software is only available for use on the iPhone 3G.

No information is available on the number of iPhone 3G units that have been jailbroken but those unlocked is said to be around the range of 800,000 to 1,500,000. If this data were to be used as a basis, then the number jailbroken could be larger than the iPhone 3G units unlocked. There is more advantage to jailbreaking than in unlocking an iPhone 3G whose users merely want a telco server of their choice. Considering this, there is no doubt that more adherents will be attracted to jailbreaking or in the use of a jailbroken iPhone 3G, greater than the number that unlocking has raised. Correspondingly, the market for jailbroken iPhone will increase; at least until the U.S. Copyright Office says no, it is illegal. There could be a deluge of jailbreaks however if it says the contrary. This might not however happen considering possible repercussions on other areas of the U. S. Copyright Law.
